If you do not agree with a decision we have made about your Ontario Disability Support Program file, you can ask to have the decision reviewed.
How to appeal a decision
The appeal process has two steps:
- Step One – you can request an Internal Review
- Step Two – you may be able to appeal to the Social Benefits Tribunal
Step One: Request an Internal Review
The first step is to request an Internal Review. This is a review of any decision about your Ontario Disability Support Program application or Income Support. The purpose of an Internal Review is to make sure that the Ontario Disability Support Program rules were applied correctly.
If you don’t agree with the decision from the Internal Review, you may be able to ask the Social Benefits Tribunal to review the decision.
Step Two – Appeal to the Social Benefits Tribunal
You may be able to appeal to the Social Benefits Tribunal if you:
- don’t agree with the Internal Review decision, or
- haven’t received a decision from the Internal Review within 10 days of your request.
Some Internal Review decisions can’t be appealed to the Social Benefits Tribunal. The letter that explains the Internal Review decision will also tell you whether or not you can appeal to the Social Benefits Tribunal.
